1. Definitions

In these Terms and Conditions:

• "Service" refers to the household planning information resources, document coaching sessions, and workplace partnership programmes provided by Nestclare.
• "User" / "you" / "your" means the individual or organisation accessing our website or purchasing our services.
• "We" / "us" / "our" refers to Nestclare, operated from 39 Pradiphat Road, Sam Sen Nai, Phaya Thai, Bangkok 10400, Thailand.
• "Content" means all materials, guides, session notes, and information produced by Nestclare.
• "Agreement" means these Terms and Conditions.

2. Acceptance of Terms

By accessing our website or purchasing any Nestclare service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you should not use our website or services.

Our services are intended for individuals aged 18 and above, or organisations acting through authorised adult representatives. By using our services, you confirm you meet this requirement.

3. Service Description

Nestclare provides educational information resources and organisational coaching in the area of household planning. Our services are strictly informational in nature. We do not provide legal, financial, medical, or professional advisory services of any kind.

Services are delivered within Thailand. We do not currently offer services outside of Thailand unless otherwise agreed in writing.

4. User Responsibilities

When using our website or services, you agree to:

• Provide accurate and truthful information when contacting us or booking services
• Use our Content for personal or organisational household planning information purposes only
• Not reproduce, distribute, or sell our Content without prior written permission
• Not use our services for any unlawful purpose
• Respect the scope of our services — we do not give advice, and you agree not to interpret our Content as such

5. Intellectual Property

All Content produced by Nestclare — including guides, session notes, materials, and website content — is the intellectual property of Nestclare. You are granted a limited, non-exclusive, non-transferable licence to use Content for your own household or organisational planning purposes.

You may not reproduce, modify, or distribute our Content commercially without our written consent.

6. Payment Terms

All prices are stated in Thai Baht (THB) and are inclusive of VAT where applicable. Payment is required prior to service delivery unless otherwise agreed. Accepted payment methods will be confirmed at the time of booking.

7. Service-Specific Terms

7.1 First Steps Family Guide

Delivery of the printed booklet is within 3–5 working days to a Bangkok address. The digital PDF is provided by email. Guides are educational only and do not constitute advice on any specific household situation.

7.2 Document Coaching Sessions

Sessions are conducted at our Phaya Thai office or by prior arrangement. The session covers information and structural guidance only. Cancellations with less than 48 hours notice may incur a rebooking fee. We reserve the right to reschedule in exceptional circumstances.

7.3 Workplace Family Partnership

Partnership terms are confirmed in a separate service agreement. Materials are provided as described in the package. The organisation is responsible for internal distribution and facilitation. Nestclare does not take responsibility for staff outcomes or decisions arising from the information provided.

8. Disclaimers

Nestclare's Content is provided for general informational and educational purposes only. It does not constitute professional advice of any kind. You should consult qualified professionals for advice on legal, financial, medical, or other matters specific to your situation.

We make reasonable efforts to ensure accuracy but do not warrant that Content is complete, current, or free from error at all times. Information draws on publicly available sources and may not reflect recent changes.

9. Limitation of Liability

To the maximum extent permitted by Thai law, Nestclare shall not be liable for any indirect, consequential, or incidental loss arising from your use of our services or Content. Our aggregate liability in relation to any claim shall not exceed the amount paid by you for the relevant service.

10. Indemnification

You agree to indemnify and hold harmless Nestclare, its staff, and representatives from any claim, loss, or expense arising from your misuse of our services, your breach of these Terms, or your reliance on our Content as professional advice.

11. Termination

Either party may terminate an engagement by providing written notice. In the event of termination prior to service delivery, a refund may be offered at our discretion. We reserve the right to refuse or terminate service to any party that misuses our Content or misrepresents the purpose of engagement.

12. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from these Terms shall first be addressed through informal negotiation. If resolution is not reached within 30 days, disputes may be referred to the courts of Thailand in the jurisdiction of Bangkok.

13. General Provisions

• Entire Agreement: These Terms constitute the full agreement between you and Nestclare regarding use of our services.
• Severability: If any clause is found unenforceable, the remainder of the Terms continues to apply.
• Waiver: Our failure to enforce any term does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our consent.

14. Changes to Terms

We may update these Terms from time to time. The effective date at the top of this page reflects the latest revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
